This is an application for seeking condonation of delay of 215 days caused in filing the appeal.

Claim petition was came to be dismissed on merits.

Being aggrieved the claimants desirous to

(2) ca13401.19 file appeal. However, since there is delay this application has been moved. The applicant has set out the reasons in para No.2 of this application. 5.

The other side resisted to condone the delay.

It reveals that the claimant's application for compensation was dismissed and he was unaware about its dismissal. There appears to be communication gap between client and lawyer.

Having regard to this fact and quantum of delay, it can be condoned. Hence, the application stands allowed. The delay caused in filing appeal stands condoned. The appeal be registered and numbered accordingly. The application stands disposed of.
