State has preferred instant application for condonation of 415 days delay cause in filing application seeking leave to file appeal against the judgment and order of acquittal passed by learned Special Judge (A.C.B.) and Additional Sessions Judge, Udgir, Dist. Latur in Special Case (ACB) No. 02 of 2015 dated 11.06.2024.

Learned APP attributes the delay to administrative decisions and procedural delays. He further submits that State has a good case on merits in appeal and hence, he seeks condonation of delay. 3.

Learned counsel for the original respondent strongly opposed pointing out that there is no plausible explanation for the delay and

In the interest of justice, the application is allowed and the delay of 415 days caused in filing the leave application is condoned. Registry to register the application.

In Application For Leave to Appeal by State, issue notice to the respondent, returnable on 15.01.2026.
