PER COURT :- 1.

The petitioner is making a grievance in respect of alleged irregularities committed by the officials of the Zilla Parishad in executing certain works in respect of repairs of primary school buildings within Aurangabad district.

We do not propose to go into the allegations made in the petition and the reply tendered by the Chief Executive Officer and Executive Engineer, Zilla Parishad, refuting such allegations. We are of the opinion that the grievance raised in the petition needs to be looked into by the Commissioner, Aurangabad Division, and appropriate action, if warranted, be taken. 3.

In the facts and circumstances of the case, we deem it appropriate to dispose of the petition with liberty to the petitioner to tender a detailed representation setting forth his grievance to the Commissioner of Aurangabad Division, Aurangabad, within a AGP/-

BENCH AT AURANGABAD (2) PIL NO.14/2014 period of two weeks, and further issue instructions to the Commissioner to consider the representation and conduct enquiry, if warranted, and take appropriate action, if deemed necessary, depending upon outcome of enquiry within prescribed period. 4.

If the petitioner tenders appropriate representation to the Commissioner within a period of two weeks, the Commissioner, Aurangabad Division, Aurangabad, shall consider the same and if deemed necessary, take appropriate action as expeditiously as possible, preferably within a period of eight weeks from the date of presentation of such representation.

With the directions as above, the petition stands disposed of. 5.

The petitioner was directed to deposit a sum of Rs.25,000/- to demonstrate his bona fides and it is informed that the amount has been deposited. Learned Counsel for the petitioner graciously submits that, petitioner is not interested in claiming refund of amount and the same be donated to Library of Advocates Association. The amount deposited by the petitioner shall be credited to the account of the High Court Bar Association Library, Aurangabad Bench, Aurangabad; Registry to act accordingly.
