This is an application for regular bail in Crime No.I-116 of 2015 registered at Virgaon Police Station, Taluka Vaijapur, District Aurangabad for the offences punishable under Sections 307, 143, 147, 148 and 149 of the Indian Penal Code.

Heard Mr. Mangesh R. Jadhav, learned counsel for Applicants and Mr. U. S. Mote, learned APP for State. Perused papers of investigation.

Incident occurred on 3rd November, 2015 at 10:00 am. Ashok Ambadas Somwanshi is the first informant. According to Complainant at the relevant time, he alongwith Yusuf Rasool Shaikh was proceeding on the motorcycle from Virgaon to Mhaski. On the way present Applicants and other two accused Rajendra Kolhe and Rajendra Bhagwat attempted to kill the Complainant by running over Scorpio vehicle on the person of Complainant. Applicants and other two accused were in the vehicle. Rajendra Kolhe was driving Scorpio. Incident was reported to Police Station at 02:00 pm on the same day. On the basis of report above said crime came to be registered. It appears that cross-complaints were lodged. As per the certificate first informant was referred to the Hospital at Vaijapur. No injury was seen on his person. There is a dispute regarding land and on payment of money between the parties.

Under these circumstances and looking to the nature of incident this Court finds it a fit case to enlarge the Applicants on bail. Hence the following order -

O R D E R

I.

Criminal Application No.6199 of 2015 is allowed. II.

Applicant No.1 Govind s/o Annasaheb Rahane, Applicant No.2 Appasaheb s/o Dattatraya Kolhe and Applicant No.3 Sadashiv s/o Sopan Nirmal are released on bail in Crime No.I-116 of 2015 registered at Virgaon Police Station, Taluka Vaijapur, District Aurangabad for the offences punishable under Sections 307, 143, 147, 148 and 149 of the Indian Penal Code, on P.R. and S.B. of Rs.15,000/- each. III.

Applicants shall not tamper with the prosecution evidence and shall make themselves available as and when required.

Bail before the Trial Court.
