[CORAM : SUNIL P. DESHMUKH AND SMT. VIBHA KANKANWADI, JJ.
DATE : 8 th November, 2019 ORDER :
1.
Heard learned counsel for the parties.
2.
The petitioner had been appointed in 2015 with respect to the caste which he claims belong to 'Thakur - Scheduled Tribe'. It appears that the undertaking of submission of caste certifcate as well as validity certifcate had been given by the petitioner. 3.
Since the undertaking given by the petitioner was not complied with, notice ensued by respondent no. 3 giving rise to present writ petition. There is no dispute on that the caste
12761.17WP certifcate of petitioner had been issued by the district supply officer, Nandurbar.
4.
While notice had been issued by respondent no. 3 on 11th October, 2017, interest of the petitioner had been protected in present writ petition under order dated 27th October, 2017, directing respondents no. 3 and 4 not to take adverse/coercive action against petitioner.
5.
In the circumstances, it would be expedient to direct respondent no. 2 - scrutiny committee, Nandurbar to proceed with and decide on the validity of pending caste claim of petitioner expeditiously, preferably within a period of six (6) months from the date of receipt of writ of order of this court. 6.
Interim relief as operating hitherto, would continue till decision by the competent authority.
7.
With aforesaid directions, writ petition stands disposed of accordingly.
