PER COURT :- 1) Heard. After arguing the matter for some time, now the counsel appearing for petitioner, on instructions, seeks permission to withdraw the petition with liberty to pursue the respondents for considering his request for appointment on compassionate ground. Such prayer is vehemently opposed by learned AGP appearing for the State, relying upon the reasons recorded by Maharashtra Administrative Tribunal. 2) In our opinion, so far as selection process in which the petitioner has undergone, the petitioner has no case inasmuch as he has participated in the selection process and was unsuccessful. However, it will be open for the petitioner to pursue the respondents concerned for appointment on compassionate ground in accordance with the policy framed by the State Government.

3) The petition is dismissed as withdrawn with liberty as prayed for.
