IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CIVIL REVISION APPLICATION NO. 112 OF 2014 Savita Vithalrao Kshirsagar and another.. Petitioners

Versus

Maula Shah Hyder Shah .. Respondents Shri Ramesh I. Wakade, Advocate for Petitioners. Shri Momin H. Shaikh, Advocate for the Respondent. CORAM : S. V. GANGAPURWALA, J.

DATE : 20TH AUGUST, 2015.

PER COURT :

.

The petitioners assail an ad-interim order of status quo passed by the Wakf Tribunal.

2.

I have heard Mr. Wakade, the learned counsel for petitioners and Mr. Momin Shaikh, the learned counsel for respondent.

3.

The learned counsel for parties are at ad-idem that Exhibit 5 i. e. an application for temporary injunction is yet to be decided. In fact, the revision is pending here for almost two years. This Court has not passed any interim orders. It would be expedient for the parties to get the Exhibit 5 decided on merits.

2 cra 112.14 4.

In the light of that, the present civil revision application is disposed of. The parties may get the Exhibit 5 pending before the Wakf Tribunal decided on its own merits expeditiously. It is made clear that, this Court has not considered the merits of submissions of either of the parties. The same are kept open. No costs.
