The learned Additional Government Pleader raises preliminary objection that the petitioner has remedy before the Maharashtra Administrative Tribunal.

It appears that, the petitioner had challenged the show cause notice before the Maharashtra Administrative Tribunal. The Tribunal dismissed the Original Application. Aggrieved thereby the petitioner approached this Court. 3.

During the pendency of the writ petition, the petitioner amended the prayer and challenged the termination order also.

The Tribunal would be in a better position to consider the facts of the matter and as the petitioner was permitted to amend the writ petition and challenge order of termination, the present petition is transferred to Maharashtra Administrative Tribunal.
