Per Court :- On 12th December, 2014 this matter was listed before this court. On that day, there was no representation on the part of the petitioner. This court [ T.V. Nalawade, J.] on the said date, passed specific order that if on 19th December, 2014, the petitioner or his counsel fail to appear, Petition will be dismissed. On 19th December, 2014 also when the matter was called out, neither petitioner nor his learned counsel appeared before the court, therefore, matter was placed on 24th December, 2014. However, it appears that on 24th December, 2014 matter was not listed. On 5th January, 2015 matter was listed. In the morning sessions, nobody appeared for the petitioner, nor there was any request for adjournment, therefore, matter was placed in the afternoon sessions.

[2] Even on the second call, nobody was present. In the order dated 5th January, 2015, I have observed that, the court could have readily dismiss

2/2 wp 1191.13 (Sr.No.13).sxw the Writ Petition however, in order to give one more opportunity to the petitioner and to his learned counsel to submit their case, matter was placed on today.

[3] Today when the matter is called out, nobody appeared nor there is any request for adjournment. Hence, Writ Petition is dismissed for want of prosecution.
