At the outset, learned counsel Mr. S.R. Zambare states that he be permitted to assist the PP and the application for the same be allowed.

Issue notice to the respondent, returnable on 06.11.2023. Learned APP waives notice on behalf of the respondent / State. 5.

Learned counsel for the applicants submits that in respect 1/3

of the alleged incident dated 24.08.2023 report came to be lodged on 01.09.2023. It is further submitted that though it was revealed to the informant that cash is missing from the cupboard in the house on 29.08.2023 itself, however no report was lodged upto 01.09.2023. It is further submitted that this could be a case of false implication. 6.

Having regard to these facts, liberty of the applicants is protected till prosecution is heard in the matter. Hence, the following order.

ORDER

(i) Till the next date, in the event of arrest of applicants in connection with Crime No. 328 of 2023 registered with Ambajogai City Police Station, Dist. Beed for the offence punishable under Section 380 r/w. Section 34 of the Indian Penal Code, they shall be released on bail on furnishing PR Bond of Rs.15,000/- (Rupees Fifteen Thousand only) each, with one surety in the like amount each.

(ii) They shall attend the concerned police station as and when called with written intimation.

(iii) They shall not contact the witnesses directly or indirectly. 2/3

(iv) They shall not interfere with the evidence in any manner whatsoever.

(v) They are further directed to cooperate the investigating agency for further investigation.
