Learned counsel Mr. Usmanpurkar along with representative officer Mr. Dinesh S. Bankar, Assistant Manager, The New India Assurance Co. Ltd. of the appellant, learned counsel Mr. A.S. Gandhi for the respondents / claimants along with respondent no. 1 - Hemlata, respondent no. 2 - Minakshi and respondent no. 4 - Bhavana, are present before the panel. Parties tender terms of compromise. The same is accepted and marked as exhibit 'X'.

Learned counsel and the parties pray to dispose of First Appeal, in view of terms of compromise.

With the assistance of learned counsel, we have verified the identity of respondent nos. 1, 2 and 4 who are present today. It is informed that respondent no. 3 who is major by this time, is unable to remain present because of medical emergency. The authority letter signed by respondent no. 3 is placed on record which is counter singed
2 909.odt by the concerned lawyer and respondent no. 1 - Hemlata. 4.
First Appeal is disposed of in terms of compromise, exhibit 'X'. 5.
As per the terms of settlement between the parties, the appellant - Insurance Company shall be disbursed an amount of Rs. 1 Lakh. Balance amount with accrued interest shall be disbursed to respondent nos. 1 to 4.

Award be drawn up accordingly.

Civil Applications, if any, stand disposed of. 8.
Court fees be refunded as per Rules.
