Heard learned counsel for the applicants.

Perused the application. This an application seeking permission for substitution of legal heirs of the deceased appellant - Radheshyam s/o Nagnathrao Patil on record. Admittedly, appellant-Radheshyam filed present appeal seeking enhancement of compensation amount. Present applicants are the legal heirs of deceased appellant and they are intending to pursue the matter by substituting them as an appellant in this proceeding.

In view of nature of subject-matter and reasons mentioned in the application, the same deserves to be allowed. Accordingly,

2 923-CA-15050-16 the application is allowed in terms of prayer clause "B". The applicants are allowed to incorporate their names in the title clause of the appeal memo being L.Rs., of deceased appellant. The applicants-appellants to carry out requisite amendment within two weeks from today.
