Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with FIR No.0261/2023, dated 20/12/2023, registered at Vedant Nagar Police Station, Chhatrapati Sambhajinagar, District Chhatrapati Sambhajinagar, for the offences punishable under sections 120-B, 406, 409, 420, 467, 468, 471 read with 34 of the Indian Penal Code. 3.

This Court, by order dated 26/11/2024, granted interim protection to the applicant. At paragraph 5 of the said order, this Court specifically noted the submissions of the learned Counsel. Thereafter, the learned APP submitted that he would verify whether any decisions were taken by the applicant before his rejection as a Member of the Board of Management, as directed in the earlier order passed by this Court dated 18/11/2024.

The learned APP now submits that there is no record to show that the applicant took any decisions before his rejection as a Member of the Board of Management. However, the learned APP contends that the present applicant was fully aware of the state of affairs in the Management and should be held responsible for the same. 5.

It is difficult to accept the submissions of the learned APP. It is to be noted that while the applicant was appointed to the Board of Management, the appointment was not accepted by the Reserve Bank of India. Furthermore, there is no record indicating that the applicant took any decisions as a Member of the Board of Management. 6.

In view of the above, the interim protection granted to the applicant by order dated 26/11/2024 stands confirmed on the following terms : - i] In the event the applicant is arrested in connection with FIR No.0261/2023, dated 20/12/2023, registered at Vedant Nagar Police Station, Chhatrapati Sambhajinagar, District Chhatrapati Sambhajinagar, for the offences punishable under sections 120-B, 406, 409, 420, 467, 468, 471 read with 34 of the Indian Penal Code, he shall be released on bail on furnishing PR bond of Rs.25,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.

936 ABA 1896-2024 ii] The applicant shall attend the police station as and when called by the police.

iii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iv] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 7.

In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 8.

It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 9.

The application stands disposed of.
