Applicant apprehends arrest in C.R. No.374/2023, registered with Kadim Police Station, Dist. Jalna, for offence punishable under Sections 392, 427, 504, 506 r/w 34 of the Indian Penal Code.

FIR is lodged by Machhindra Ramdas Dhage, alleging that on 20/08/2023, he along with Badrinath Narayan Dhage and Kapil Anil Waghmare proceeded towards Jalna in his Swift car. After finishing their work, in the evening they were returning to Shiraswadi. At that time, Rushi Jadhav and Lakhan Dhage (applicant) came on scooty and signaled to stop the car. Informant, therefore, got down from the car and asked them as to what has happened. At that time, they both abused him and said that he is earning too much money and he should pay Rs.50,000/- to them. When informant refused to pay, Rushi Jadhav caught his collar and SVH
2 941-ABA-1727-23.odt by pointing knife snatched Rs.3200/- from his pocket. Applicant broke rear glass of his car with stone and threatened to kill him. 3.
Heard learned advocate for applicant and learned APP for respondents/State. Perused the investigation papers. 4.
25 crimes are registered against Rushi Jadhav at various police stations, he was arrested and is released on regular bail. Applicant has no criminal antecedents and considering the allegations made against him in the FIR, and the fact that he was granted interim protection and has co-operated in investigation, so also, since nothing is to be recovered from him, his pre-trial custodial detention is not necessary.

In the result, application is allowed by confirming interim protection granted to appellant by order dated 17/10/2023. 6.
Applicant shall attend concerned police station as and when called by investigating ofÏcer and shall co-operate in the investigation. Applicant shall not tamper prosecution evidence. (NITIN B. SURYAWANSHI, J.) SVH
