Learned counsel appearing for the applicant submits that inadvertently, statement was made before this Court that chargesheet has been filed in the crime and, accordingly, application was withdrawn with liberty to approach the Sessions Court. He would further submit that till this date, charge-sheet is not filed. Hence, urged to recall the order dated 3.10.2023.

Apparently, the order is passed based on the statement made by the learned advocate for the applicant, which was inadvertent. 3.

In that view of the matter, the application is allowed. The order dated 3.10.2023 is recalled. Bail application No.1590 of 2023 is restored to its original stage. Application is accordingly disposed off.
