Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant was granted an opportunity to file fresh bail application after recording the statement of deceased. However, before recording the statement of the deceased, he died. The applicant has no antecedents to his discredit. The incident appears to be happened out of the quarrel of children. The similarly situated co-accused have been granted bail. Hence, the applicant deserves bail.

(i) Bail Application is allowed.

40-BA.2012-2022.odt (ii) Applicant AVINASH SUBHASH KHARATE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.135 of 2021, registered by Police Station Killari, District Latur, for the offence punishable under Sections 302, 307, 324, 323, 504, 506, 143, 147, 148, 149 of the IPC, on the condition not to tamper with the prosecution witnesses.
