Ms. Talekar, the learned counsel for the petitioner submits that, the Hon'ble Minister on 09th September, 2014 had passed order granting extension and time to excavate the sand, however, said order was not implemented. The petitioner approached the Hon'ble Minister seeking implementation of the said order. The said matter was heard by the Hon'ble Minister on 14.09.2016, however, no orders are passed and in the interregnum the tenders are issued in respect of various sand spots including sand spot for which order of extension was passed by the Hon'ble Minister.

The learned Additional Government Pleader on instructions states that, the hearing was concluded on 14.09.2016 and within two weeks the Hon'ble Minister would pass an order. 3.

Considering the above, we pass following order. 4.

The tender process in respect of writ sand spot shall not be finalized till the Hon'ble Minister passes order and communicates to the petitioner and for further one week thereafter. The writ petition is disposed of. No costs. 5.
