1] This is an application for condonation of delay in filing an appeal by the State challenging the award of the learned reference Court. The delay is of 1369 days. 2] Heard the learned AGP appearing for the applicants. Shri Shinde, learned counsel appearing for the non applicant vehemently argued that, the delay is not properly explained and it be condoned only on the condition that the State should deposit entire amount of compensation. Such can not be a consideration of condonation of delay.

ca.2296.14 & ors.doc - 2 - 3] The averments made in applications are not controverted by filing counter. Delay is sufficiently explained. Hence the same is condoned. First Appeals be registered.
