CORAM : SMT. VIBHA KANKANWADI, J.
DATE : 4th OCTOBER, 2019.
ORDER :
.
Issue notice to the respondents. Learned AGP waives notice for respondents-State and Special Land Acquisition Officer. Learned Advocate Mrs. Vaishali Jadhav waives notice for respondent No.3.
2.
Present applications have been filed for condoning the delay in filing restoration applications and also the prayer of restoration of the appeals which came to be dismissed for non removal of office objections. In fact, when the impugned order was passed by learned Registrar (Judicial) refusing the registration for non removal of objections, the respondents were never served. Now, the applicants have come with the case that the learned Advocate representing the applicants, due to over sight, remained absent and did not remove the office objections. When the advocate is blaming herself, the applicants shall not suffer. Hence, the delay stands condoned.
3.
Civil Applications stand allowed.
4.
First Appeals stand restored with a condition that the office objections should be removed on or before 08.11.2019. 5.
In case of failure on the part of the applicants to remove the office objections within the stipulated period, it shall be treated that again the registration is refused automatically.
6.
Appellants in all these cases to file an undertaking that they will not claim interest for the period of delay, in case of success to their
respective appeals. Such undertaking should be filed on or before 08.11.2019.
