Instant application is for grant of regular bail on account of arrest of applicant in Crime No.0071 of 2024 registered at Dharangaon Police Station, District Jalgaon for offence punishable under sections 394, 395, 427, 120-B r/w section 34 of Indian Penal Code and section 4/25 of the Arms Act. 2.
Learned counsel pointed out that, present application is successive attempt to seek bail and initially it was rejected. That, applicant is behind bars since February 2024 i.e. more than a year.
-2He pointed out that, in all five persons are booked. Accused no.2 is already granted bail, whereas accused nos.3 and 4 have been discharged. Applicant is arrested on suspicion on alleged recovery of some amount and precisely for same reasons learned trial court has rejected present application. Learned counsel submitted that, applicant is arrested because there were several PCR before MCR and therefore there is possibility of applicant was shown to informant and witnesses before T.I. Parade itself. That, now investigation is over and charge sheet is already filed in May 2024. Therefore, no purpose would be served by further detention. Hence, he urges for grant of bail.

While opposing the bail application, learned APP pointed out that, Rs.1,60,00,000/- was robbed in broad daylight. That, from present applicant Rs.48,00,000/- are recovered. That, even vehicle seized at his instance was carrying articles meant for committing above offence. Learned APP submitted that, five crimes of similar nature are committed by him and as such, according to him it is unsafe to release applicant on bail. Lastly, learned APP submitted that charge is already framed and as such trial has already commenced.

Heard. Perused the papers. FIR dated 17.02.2024 is at
-3the instance of one Yogiraj Patil and he has reported that on 17.02.2024 while he was traveling in his car with driver and after withdrawing cash from Axis bank, his vehicle was given dash by another Scorpio. Four persons alighting from it, broke the window glass by means of iron road, assaulted the informant and forcibly snatched bag containing Rs.1,60,00,000/- cash and fled. On above report, crime has been registered against four unknown persons. Charge sheet shows that, T.I. parade has been conducted on 15.03.2024 and applicant is identified along with another accused. Learned APP pointed out that, Rs.48,00,000/- cash is recovered from present applicant. Moreover, charge is framed on 13.02.2025 and therefore as trial has commenced, this court is not inclined to entertain instant bail application.
