RESPONDENT .....
Shri A.P. Bhandari, Advocate for petitioners Shri S.S. Dande, Advocate for respondent .....
CORAM:
MANGESH S. PATIL AND R.G. AVACHAT, JJ.
DATED :
23 July 2020 ORAL ORDER :
Learned Advocate Mr. Dande for the respondent Corporation, on written instructions, submits that the petitioner had submitted a representation dated 13/10/2015 and has fled another representation dated 1/7/2019 raising all the disputes which it has raised in the Writ Petition, with the competent authority of the Corporation. The competent authority is fnding it difcult to decide the representation since the Writ Petition is pending. He, therefore, submits that the competent authority is ready to dispose of the representation on its own merits according to the rules, regulations and policy of the Corporation, and the Writ Petition may be disposed of.
Writ Petition No.9/2015 (( 2 )) 2.
Learned Advocate Mr. Bhandari for the petitioners submits that the Writ Petition has been fled long back, in the year 2015. There is interim relief granted to the petitioner which is in operation till date. The authority may decide the representation on its own merits, however, the interim relief may be directed to continue for a period of four weeks after such decision on the representation.
3.
Having considered the rival submissions and the record, the proposal being submitted by the Corporation seems to be innocuous, it would certainly take care of the rights of the petitioners.
Therefore, the competent authority of the Corporation can be allowed to decide the representation on its own merits according to the rules and regulations as well as policy of the Corporation and the interim relief can be extended up to two weeks after such decision.
4.
With this understanding, the Writ Petition is disposed of. The competent authority shall decide the representation of the petitioner as early as possible. The interim relief shall continue to remain in force up to a period of two weeks after such decision. All the contentions are kept open. (R.G. AVACHAT) (MANGESH S. PATIL) JUDGE JUDGE fmp/-
