Mr. Biradar, learned counsel for the petitioner submits that the petitioner is not challenging the appointment of the person appointed as Headmaster but is seeking direction against respondent no. 3 / The Education Officer (Secondary), Zilla Parishad, Nanded to decide the seniority only.

Under Rule 12 of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981 it is for the Education Officer to decide the

2 wp 13263.19 seniority, if objection is raised, of course, after hearing all the interested parties.

In case the objection to the seniority list is raised by the petitioner and same is pending with the Education Officer, the Education Officer shall decide the same in accordance with law, after hearing all parties concerned.

Writ Petition accordingly stands disposed of. No costs.
