Learned counsel for respondents 4 and 5 states on instructions that the whole process of allotment of MIDC plots on the basis of online applications received by MIDC has been abandoned and none of the applicant who tendered application online has been considered for allotment of the plots including the petitioner. Communication in that regard issued by the MIDC is placed on record and marked 'X' for identifcation. 2.

Since the process of allotment of plots has been abandoned by MIDC and it has been decided to issue fresh advertisement and call for online applications, it would not be appropriate to direct MIDC to consider application of petitioner in isolated manner. It would be open for the petitioner to tender online application as and when respondent issues advertisement calling for the applications for allotment of plots.
