I have heard the learned Advocates for the respective sides. This Arbitration Application is moved for seeking an appointment of an Arbitrator. There is no dispute that the issue raised is subject matter of an agreement, which provides for arbitration.
The learned Advocates for the respective sides submit that Mr. Justice P.V.Hardas (retired Judge, Bombay High Court), who resides in Aurangabad, can be appointed as a sole arbitrator. The litigating sides would independently consult Justice Hardas insofar as the terms and conditions of arbitration are to be settled.
The Registry of this Court shall, accordingly, initiate steps for placing the papers in relation to this proceeding before the learned

The processing fees shall be Rs.5000/- (Rupees Five Thousand) for the purpose of processing these papers in order to place the same before the learned Arbitrator. The said amount shall be deposited by the Applicant with the Registry of this Court within two weeks from today. By consent of the parties, this Arbitration Application is, accordingly, disposed of.
