DATE : 12th July, 2017 ORAL ORDER The claim for transfer is opposed on the ground that if prayer for transfer is granted, same will cause substantial inconvenience to the non-applicant/husband. Submission is made that instead of transferring the matter to the Court of Civil Judge (Senior Division), Jalgaon, it be ordered to be transferred to the Court of Civil Judge (Senior Division),

In view of the fact that other proceedings are already pending in the Court of Judicial Magistrate F.C., at Jalgaon, i.e. preferred u/s. 125 of the Criminal Procedure Code and the applicant since is custodian of minor daughter, in my opinion, the application needs to be allowed in terms of prayer clause "A". Hence application stands allowed in terms of prayer clause "A.
