The present matter was referred for mediation and I am happy to note that, the mediation has become successful. The learned Mediator has forwarded his report along with the terms of settlement, which are signed by the parties to the lis. The learned Counsel appearing for the parties submitted that, the present appeal be disposed of in terms of settlement. 2.

I have gone through the terms of settlement. The settlement, which has been arrived at is within four corners of law, it has, therefore, to be accepted. It is accordingly accepted.

The First Appeal stands disposed of in terms of the settlement. The Award be drawn accordingly. The terms of settlement shall form the part of the Award.

The appellant - Insurance Company is entitled for the refund of the Court Fee in accordance with law. 5.

After the amount is deposited, it would be open for the Original Claimant No.1 to withdraw the same. 6.

The Registry shall permit the withdrawal in the name of Original Claimant No.1, if he submits the consent of all other claimants, by verifying the said position. 7.

The Appeal stands disposed of accordingly.
