THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Applicant : Mr. Jayabhar Dattatraya R. AGP for Respondent/s - State : Mr. S. N. Kendre Advocate for Respondent No.1 : Mr. Choudhary Nilesh S. ...
CORAM : SANDIPKUMAR C. MORE, J.
DATE : 15.02.2023 PER COURT :
Heard rival submissions. The applicants are seeking condonation of delay of 3877 days which appears to be caused due to their poor financial condition. The learned counsel for Acquiring Body by filing reply strongly opposed the application on the ground that there is not only huge delay but also circulation delay. 2.
However, considering the statutory right of the applicants, the delay of 3877 days stands condoned subject to condition that the applicants shall not claim any interest for the aforesaid period of delay and also for the delay in circulating the matter belatedly.
3.
Appeal be placed for admission after removal of office objections, if any.
4.
The application is accordingly disposed of.
