The learned counsel Shri Yuvraj Kakde submits that he has instructions to appear for respondent nos. 1, 2, 4 and 5. Respondent no.3 is already served however, no one has entered appearance for respondent no.3.

Heard Shri Ambhore, the learned counsel appearing for the applicant and Shri Kakde, the learned counsel appearing for respondent nos. 1, 2, 4 and 5. Though the learned counsel appearing for the respondents has opposed for condoning the delay stating that the reasons as are assigned are insufficient to condone the delay, for the reasons stated in the application, which according to me

18-CA-13640-2018 delay.odt (2) are just and sufficient, the delay caused of 94 days in filing the appeal is condoned.
