IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 14156 OF 2017 SHAMSUNISSA SIDDIQUI ABDUL QUADIR THROUGH HER GPA ABDUL QUADIR KHWAJA RAHIMUDDIN

VERSUS

DISTRICT WAKF OFFICER BEED AND ANOTHER ...

Advocate for the Petitioner : Shri S. D. Hiwrekar Advocate for Respondent No.2 : Shri Sayyed Tausef Yaseen ...

CORAM : RAVINDRA V. GHUGE, J.

DATED : 13th AUGUST, 2018.

...

PER COURT :

1.

The learned Advocate Shri. S. D. Hiwrekar submits that he would be appearing on behalf of the petitioner. 2.

Shri S. S. Kazi, learned Advocate submits that his appearance may be discharged.

3.

As such, the appearance of the learned Advocate Shri Kazi is discharged.

4.

I have briefly heard the learned Advocates for the respective sides.

5.

It is pointed out that the impugned order can be assailed before the Collector (Atiyat), by way of a statutory Appeal.

39-14156-17.odt 6.

The learned Advocate for the petitioner has raised several grounds. Each of these grounds can be considered by the Collector (Atiyat) in the statutory appeal. 7.

In view of the above, this petition is disposed off with liberty to the petitioner to approach the Collector (Atiyat). All contentions are kept open. The time spent by the petitioner in this Court from 30/10/2017 till the passing of this order would be a good ground for condonation of delay only if the petitioner lodges her Appeal on or before 15/09/2018. 8.

If such an Appeal is lodged as above, the ad interim protection granted by this Court on 12/12/2017, would continue till 15/10/2018.

9.

The petitioner would be at liberty to pray for interim relief and the concerned authority would consider the said prayer on its own merits without being influenced by the ad interim protection granted by this Court.
