The learned counsel for the applicant brought to my notice the order passed by this Court on 02.05.2019. It is submitted that present application was remained to be fled. A request is made to pass similar order as has been passed in the companion matters on 02.05.2019. The learned counsel appearing for the respondent does not have any objection for passing such order. Hence, the following order is passed:

ORDER

i) Application is allowed.

ii) The applicant in present application is allowed to

917-CA-12966-2019 (2) withdraw the amount subject to outcome of writ petition on furnishing solvent surety to the extent of amount to be withdrawn as well as fling of written undertaking to the efect that in the event the petition is allowed and the applicant is required to redeposit the amount, he shall deposit the same within eight weeks from the date of such order.

iii) The civil appilcation is disposed in above terms. iv) List the petition for further consideration on 03.12.2019 along with pending petitions.
