Respondent No.2 filed affidavit in reply. In para 4 of the affidavit in reply, it is stated that, the petitioner's name appeared at Sr. No. 402 in general seniority list and from reserved category of scheduled caste, his name is at Sr. No.23. This statement is disputed by the learned counsel appearing for the petitioner. He submits that, the petitioner's name stands at Sr. No.5 in the reserved category i.e. scheduled caste and in general category the name of petitioner is at Sr. No. 151. He further submits that, the date of appointment of the petitioner, which is mentioned in paragraph 4 in the affidavit in reply of

677.15CP Respondent No.2 is also not correct.

We do no wish to enter into controversy, whether the petitioner stands at which serial number, suffice it to say that, as and when the turn of the petitioner will come as per the seniority, he will be absorbed in Latur district.

So far contention of the learned counsel appearing for the petitioner about correct position in seniority list is concerned, the petitioner can approach the Chief Executive Officer, Zilla Parishad, Latur, by way of filing representation within two weeks from today. In case, such representation is filed, the Chief Executive Officer to hear the petitioner and decide the same on its own merits, as expeditiously as possible and preferably, within three weeks thereafter. 5.

Contempt Petition stands disposed of in above terms.
