We have perused the order passed by the Hon'ble Supreme Court of India dated 25/09/2020. It is informed that the respondent mother, alongwith the child born out of the marriage, is presently in USA. Both the parties are willing and desirous of a reference to the Mediator for mediation purpose. The respondent/wife is willing to participate in the meditation proceedings through virtual mode. 2.

The learned Advocates for the respective sides submit on instructions that the learned Adv.Mr.R.J.Godbole be appointed as a khs/Nov. 2021/74

In view of the above, the office of the High Court Legal Services Sub Committee, Aurangabad shall refer this matter to Mr.R.J.Godbole for mediation. We direct the Secretary of the High Court Legal Services Sub Committee, Aurangabad to contact the learned Mediator for listing the matter for initiation of mediation proceedings through video conferencing, from the A.D.R. Center at Aurangabad. The learned Advocates for the respective sides assure of fullest co-operation. 4.

After the learned Mediator submits the report, the parties are at liberty to circulate this matter for hearing. We make it clear that in the event either of the parties intends to enter into a second marriage, the same shall not be performed without the leave of this Court. 5.

In view of the above direction, CA No.12668/2019 is rendered infructuous.
