ORDER

Heard both sides.

The present applicant, who is arrested by Police Station, Ashvi, Taluka Sangamner, Dist. Ahmednagar, in C.R. No. I-33/2014 for the offences punishable under sections 376, 354 (B) (D) (2) and 511 of Indian Penal Code, is praying for release on bail. 3.

Earlier application of the present applicant bearing No. 6175 of 2014 was dismissed by this court on 27-11-2014 as the investigation was in progress at that time.

The allegations would show that twenty six year old married prosecutrix was going by road on the date of incident to her field. At that time, allegedly, present applicant had made sexual advances towards her and made her lie down on the ground, however, at that time her nephew came and she was rescued. On the basis of her complaint, aforesaid crime came to be registered.

Finding that the applicant is behind the bar from 1-10-2014 and that the investigation is now complete, he can be released on bail on certain conditions.

As such, following order:

(A) Upon his execution of P. R. Bond in the sum of Rs. 25,000/- with one surety in the like amount, the applicant be released on bail in C.R. No. I-33/2014 for the offence punishable under sections 376, 354 (B) (D) (2) and 511 of Indian Penal Code, registered with Police Station, Avshi, Taluka Sangamner.

(B) The applicant shall not enter the territorial jurisdiction of Avshi, Taluka Sangamner for a period of two years, or till the trial is concluded, whichever occurs earlier. (B) The applicant shall not attempt to influence any of the prosecution witnesses in any manner.

Application is thus allowed and disposed of.
