The petitioner seeks transfer of the validation proceeding to the scheduled tribe scrutiny committee at Pune.

Mr. Bajaj, learned counsel appears for the respondents and submits that because of the petitioner, the members of the committee have passed an order that the matter shall not be dealt by them.

In fact, we would be slow to accept the

2 wp 12901.18 request of the petitioner for transfer of the matter. The transfer cannot be ipse dixit, however as members of the committee themselves have passed an order that they would not deal with the matter we had asked the learned A.G.P. to take instructions which other committee would take up the matter. The learned A.G.P. submits that the scrutiny committee at Thane would decide the proceeding.

In the light of above, the matter of the petitioner is transferred to scrutiny committee at Thane.

Writ Petition is disposed of accordingly. No costs.
