IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 11943 OF 2015 KIRAN LAXMAN SONWANE AND ANOTHER

VERSUS

MADANLAL NARAYAN BAPECHA AND ANOTHERS ...

Advocate for Petitioners : Shri Wani Girish V Advocate for Respondents : Shri Yawalkar Siddharha B.. ...

CORAM: RAVINDRA V. GHUGE, J.

DATE :- 08th August, 2017 Per Court:

The Petitioners are aggrieved by the order dated 05.11.2015 passed by the Trial Court by which application Exhibit-78 seeking amendment, has been rejected.

I have heard the submissions of Shri Wani and Shri Yawalkar, learned Advocates appearing for the litigating sides. The Petitioners' contention is that they desired to bring on record the fact about the pendency of RCS No.144/2010 between the Defendants inter-se. Besides indicating to the Trial Court about the pendency of the said Suit, no other amendment is sought. Considering the above, I do not find that any amendment is necessary for informing the Court about the pendency of RCS

*2* 908wp11943o15 No.144/2010. The Petitioners can very well file certified copies of the said proceedings and orders passed therein, if any, so as to bring to the notice of the Trial Court the dispute between any of the litigating parties in the said suit.

With the above observations and liberty, this Writ Petition is disposed of without causing an interference in the impugned order. kps (RAVINDRA V. GHUGE, J.)
