Learned counsel for the petitioner submits that the petitioner original plaintiff has filed an application Exh.114 for framing of additional issue, however, the learned Judge of the trial court has not passed any order on the said application. Though other side has given no objection to frame the additional issue, the learned Judge of the trial court has simply passed order "file". 2.

In view of above, writ petition is disposed of by directing the trial court to decide the application Exh.114 on its own merits. ( V. K. JADHAV, J.) rlj/
