By consent of both sides, heard finally at the stage of admission.

During the course of hearing, this Court is informed that Second Appellate Authority has reduced the punishment imposed upon the Respondent and directed withholding of one increment for a year without permanent effect.

Learned Counsel for the Respondent, on instructions from the Respondent who is present in the Court, records no objection for setting aside the order passed by the Industrial Court, Dhule in Complaint (ULP) No. 51/2019.

Considering the fact that the Second Appellate Authority has already reduced the punishment imposed upon the Respondent and also in view of the fact that the said punishment is not shockingly disproportionate, this Court finds no reason not to accept the statement of Respondent.

In view of above, Petition stands allowed in terms of prayer clause 'C'. The punishment imposed against the Respondent only to the extent of withholding of one increment for a year shall be maintained.
