Though the respondent is served, none appeared for him. 2.

This application is for transfer of the proceedings pending before the Family Court, Nashik bearing Petition A No.328 of 2004 to the Family Court at Parbhani.

It is stated in the application that, the applicant is presently residing at Parbhani with her parents. The distance between Parbhani to Nashik is around 381 k.m. The applicant has already filed proceedings under Section 125 of the Cr.P.C. bearing Petition E No.145 of 2024 in the Family Court at Parbhani where the respondent had already appeared.

Ethape ( 2 ) 945 MCA-337-2024 One more proceedings under Domestic Violence Act bearing PWDVA No. 155 of 2023 is filed in the Family Court at Parbhani. The learned Advocate therefore vehemently submitted that, it would be in the interest of justice to transfer the proceeding of Petition A No.328 of 2004 to the Family Court at Parbhani.

Considering the above, this Court is inclined to allow the application. Hence, the following order:

ORDER

(i) Misc. Civil Application is allowed in terms of prayer clause (B) which reads as under:- "B] The proceedings of Petition A No. 328/2024 may kindly be withdrawn from the file of Family Court, Nashik and the same may kindly be transferred to the Family Court at Parbhani for its disposal according to law."

(ii) Application stands disposed off.
