Heard the learned counsel for the applicant and the learned APP for the respondents-State.

The applicant is apprehending arrest in connection with Crime No. 305/2024 dated 11.10.2024 registered at Basamba Police Station, District Hingoli for the offences punishable under sections 118(1), 352, 351(2)(3), 115(2), 76, 74, 3(5) of B.N.S., 2023.

It appears that one incident took place and two cross F.I.Rs. are given by the applicant and informant against each other and both the parties were admitted in the Government Hospital. It appears that the incident started on account of dispute about common boundary between the land of the applicant and the informant. Minor injuries were suffered by both the parties.

Considering the nature of the incident and the injuries sustained by the injured, interim protection was granted to applicant No. 2 on 14.11.2024. In view of the above, interim protection granted to applicant No. 2 needs to be confirmed and application of applicant No. 1 needs to be allowed on following terms and conditions.

In view of the above, interim protection granted to applicant No. 2 is confirmed the application of applicant No. 1 is allowed on the following terms :
i] In the event the applicant No. 1 is arrested in connection with Crime No. 305/2024 dated 11.10.2024 registered at Basamba Police Station, District Hingoli for the offences punishable under sections 118(1), 352, 351(2)(3), 115(2), 76, 74, 3(5) of B.N.S., 2023, he shall be released on bail on furnishing PR bond of Rs.15,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.
ii] The applicants shall attend the police station as and when required.
iii] The applicants shall not tamper with the evidence of the prosecution in any manner. They shall not influence the informant, witnesses and other persons concerned with the case. iv] The applicants shall co-operate with the investigation and also in the proceedings before the trial Court.

In the event, the applicants violate any of the conditions specified in this order, it shall be liable to be cancelled. 7.
It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.

The application stands disposed of.
