The applicant is seeking regular bail in Crime No. I-247 of 2014 registered at M.I.D.C. Waluj Police Station, District Aurangabad for the offence punishable under Section 395 of Indian Penal Code.

Learned Counsel for the applicant submits that the investigation in the matter is complete and charge sheet is already filed. He would then urge that other accused Kishor Kaluram Kale and Sundip Anjan Pimpale are already released on regular bail by an

6283.15crapln -2order dated 03/03/2015 passed by this Court. He would then submit that there are no criminal antecedents as against the applicant. 3.

Learned A.P.P. opposed the application on the ground that the applicant was caught on the spot while committing the offence in question, as such, there is strong case against him. 4.

Having bestowed my thought to the submissions, it is to be noted that the investigation in the matter is complete and charge sheet is already filed. Other accused Kishor and Sundip are released on bail by this Court vide order dated 03/03/2015. There are no criminal antecedents as against the present applicant. As such, the application deserves to be allowed. Hence, the following order:- The applicant be released on regular bail, in connection with Crime No. I-247 of 2014 registered with M.I.D.C. Waluj Police Station, District Aurangabad, for the offence punishable under Section 395 of Indian Penal Code, on executing P.R. bond of Rs.25,000/- with one surety in the like amount. 5.

The application is allowed in above terms.
