This petition has been moved for direction to the trial Court for expedite hearing of the case, being Regular Criminal Case No. 31 of 2019 pending on the file of J.M.F.C., Kandhar, and conclude the same within a reasonable time.

It is a case of in all fourteen accused, seven are before the Court and other seven are stated to be of rival side. It is also informed that due to absence of co-accused of other side, there is hindrance in framing of charge and going ahead with the case. The application moved by petitioners under Section 317 of Code of Criminal Procedure is pending for long. 1 / 2

We, therefore, hereby direct the learned Magistrate to decide petitioner's application filed under Section 317 of Code of Criminal Procedure within one month and decide further course of action and take the case to it' s logical conclusion at the earliest. With these directions, criminal writ petition stands disposed of.
