Heard for some time. The learned Advocate for the petitioners though tried to convince this Court that when there is purely question of law involved in the matter, writ petition can be entertained by the High Court. In the present petition, the challenge is to the order passed by the Circle Officer (Revenue) holding that the entries on the basis of will-deed cannot be taken by the revenue authority by deciding question of validity of the will-deed and party has to approach the civil court and establish rights over the properties. The learned Advocate submits that in the present case the will-deed is executed in favour of the respondent and still the Circle Officer has directed this petitioner to approach the civil court.

Already there is remedy available to approach the Tahsildar by invoking provisions under the Maharashtra Land Revenue Code. In view of this, this Court is not inclined to entertain this petition.
