Learned advocates for the parties point out that under order dated 26th August, 2015 passed by Registrar (Judicial), the second appeal stood dismissed against respondent No.2 for want of service.

Learned advocates state that respondent No.2 is present in the court. Learned advocates state that since parties have arrived at compromise and respondent No.2 is the signatory to the same, dismissal order against respondent No.2 be set aside. Accordingly, the same is set aside.

In view of compromise arrived at between the parties and in view of order passed in civil application No.16127 of 2016, the second appeal stands disposed of in terms of the compromise. Decree be drawn accordingly.
