Heard learned counsel appearing for the applicant and the learned counsel appearing for the acquiring body.

Considering the grounds raised in exception to the impugned Awards and the averments in the application for withdrawal of the amount, I deem it appropriate to pass the following order.

O R D E R

1.

The applicant is permitted to withdraw 50 % of the deposited amount on submitting an undertaking to the satisfaction of the Registrar (Judicial) of this Court that in the event of adverse order passed in the appeal, he shall deposit the said amount within a 1/2

934.odt period of 12 weeks.

2.

The applicant is allowed to withdraw balance 50% amount on furnishing Bank Guarantee in the like amount.

3.

Civil application for withdrawal of amount stands disposed of in above terms.
