The applicant, by this application, seeks to amend the petition by inserting paragraph nos. 10-A to 10-J (i to xi) and C-1 on the ground that though the charge-sheet has been filed, fair investigation has not been carried out. Learned Counsel for the applicant has pointed out to us that even though certain golden & silver ornaments and cash amount came to be stolen away from the SG Punde, PA

954APPLN3277.2021 -2jewellery shop of the applicant worth Rs. 29,55,500/- (as per the valuation at the time of registration of the crime), the Investigating Officer has neither carried out any investigation to recover the said jewellery & the cash amount nor did he conduct the identification parade, though the identity of those dacoits has been disclosed in the CCTV camera installed in the jewellery shop.

In view of the above and for the reasons cited in the application, same is allowed in terms of prayer clause ' B' thereof.

Criminal Application No. 3277 of 2021 is accordingly disposed of.
