1] Heard. For the reasons stated in Criminal
Application No.197/2025 for assisting to the P.P., the same is allowed. Criminal Application is disposed of accordingly. 2] Heard learned counsel for the applicants, the learned APP for the respondent-State and the learned counsel for Assist to P.P.
3] The applicants in ABA Nos. 2060/2024 and 1955/2024 are apprehending arrest in connection with Crime No. I-976/2024, registered with Tophkhana Police Station, Taluka Nagar, District Ahmednagar, for the offence punishable under Sections 115 (2), 118 (2), 3 (5), 351 (2), 351 (3), 352 of B.N.S. 2023.
3] The learned counsel for the applicants submits that this Court, by order dated 04.12.2024 in ABA Nos.2060/2024 and 1955/2024, has granted interim protection in favour of the applicants. In terms of the said order, the applicants have attended the concerned police station and have co-operated with the investigation. 4] The learned counsel for the complainant has filed an application to assist to P.P. in which she has also submitted that compromise has taken place between the parties and in terms thereof they would make appropriate application for quashing of proceedings.
5] Considering that the dispute between the parties is settled, so also, considering that this Court has already granted interim protection in favour of the applicants and the applicants have attended the concerned police station and have co-operated with the investigation. Considering the same, interim protection granted by this Court by order dated 04.12.2024 in ABA No.2060/2024 & 1955/2024, stands confirmed, in the following terms : i] The applicants shall attend the concerned police station as and when required by the investigating officer.
ii] The applicants shall not tamper with the evidence of the prosecution in any manner. They shall not influence the informant, witnesses and other persons concerned with the case.
iii] The applicants shall co-operate with the investigation and also in the proceedings before the trial Court.
6] In the event, the applicants violate any of the conditions specified in this order, it shall be liable to be cancelled.
7] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
8] The application stands disposed of.
