PER COURT :- 1) Heard leaned Counsel for the applicants and learned Counsel appearing for Respondent/MSRTC. 2) After having read the impugned judgment and after having gone through the grounds of objections raised in memo of appeal, in exception to the impugned judgment, I deem it appropriate to pass the following order, -

ORDER

i) The applicants are presently permitted to withdraw 40% of the amount on submitting an undertaking that, if any adverse order is passed BDV

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD against them in the appeal, they will re-deposit the amount within four months of passing such order; ii) Balance amount be invested in a Fixed Deposit Receipts in any Nationalized Bank, till disposal of the appeal.

iii) The Civil Application for withdrawal of the amount is disposed of.

3) Place the matter for admission on 24th January, 2017.
