Heard the learned counsel appearing for the appellant/applicant and the learned A.P.P. appearing for the Respondent/State.

Perused the notes of evidence. There is overwhelming evidence brought on record by the prosecution. Prima facie, the findings recorded by the trial Court appears to be in consonance with the

6261.16appln evidence brought on record. We do not wish to elaborate on the evidence since the appeal filed by the accused is pending.

For the reasons aforesaid, the application stands rejected.

The Registry of this Court shall send original Record and Proceedings to the Registry of the Special Judge (MCOC Act), Aurangabad. Upon receiving the original record and proceedings by the Registry of the Special Judge (MCOC Act), Aurangabad, the Registry of concerned Court shall prepare the paper book and send it back along with original record and proceedings, as expeditiously as possible, and preferably within three months from receipt of the original record and proceedings.
