It is submitted that the validation proceedings in respect of the tribe claim of the petitioner is pending with the Respondent No.3 Committee. The petitioner is studying in final year Engineering course. The petitioner is apprehending that he may not be allowed for

2 W.P.No.12859/17 examination and is insisting for full fees.

Considering above, we pass the following order :

(a) The Respondent No.3 Committee shall decide the validation proceedings in respect of the tribe claim of the petitioner expeditiously, preferably within six (6) months. The petitioner shall cooperate in expeditious disposal of the said proceedings. The petitioner shall appear before the Committee on 7.12.2017.

(b) The petitioner shall file an undertaking with the Respondent No.2 that in case his tribe claim is invalidated, he will pay full fees for all the years.

(c) In case the petitioner is otherwise eligible, the Respondent No.2 shall not refrain the petitioner from prosecuting further studies and shall not insist for full fees, only on the ground that validation proceedings are pending. The degree certificate may not be issued till the

3 W.P.No.12859/17 validity certificate is produced or any orders are passed by the Court.

(d) The Writ Petition is disposed of. No costs.
