Heard learned counsel for the respective parties. 2.

The present petition is directed against the order dated 04.02.2013 passed by the District Supply Officer, Nanded. 3.

The learned AGP raised a primary objection that the petitioner is having alternative and equally efficacious remedy to challenge the said order before the Deputy Commissioner, (Supply). 4.

In view thereof, the present petition is disposed of as is not maintainable.

The petitioner is at liberty to file appropriate proceeding before the Deputy Commissioner, (Supply).

6.

The delay caused in prosecuting the present petition shall be considered by the Deputy Commissioner, (Supply) while considering the application for condonation of delay.
